Game Terms & Privacy

Version 2026-10-23 · valid from 23 October 2026

These terms apply to the city games offered at game.benidormexpats.com and benidormexpats.com/games (the “Games”). The Benidorm Expats community website has its own terms. Please read these terms before you buy a game — you accept them at checkout.

1. Who we are

The Games are operated by Jakub Krejci, Krajni 268/3, 415 01 Teplice, Czech Republic, Business ID: 03854183 (“we”, “us”). Contact: info@krejcijakub.cz.

2. What the Games are

The Games are self-guided city games played outdoors in Benidorm on your own phone: you walk to locations, solve tasks, take photos and confirm your location. You play solo. A game needs a working internet connection, location (GPS) and, for some tasks, the camera. Battery use can be high.

Your result is your total time from start to finish (pauses are not counted) plus penalty minutes: +1 minute for a wrong answer, +2 minutes for a hint and +10 minutes for a skipped checkpoint. In a mystery game, a wrong final accusation ends the game as “case unsolved” and is not ranked.

3. Your account

You need an account to play and you must be at least 18 years old. Give true information, keep your login private and don’t let anyone else use your account.

4. Prices and payment

The price of each game is shown in euros before you pay and is the final price. Payment is made by card through our payment provider Stripe; we never see your card number. The contract is concluded when your payment is confirmed. A solo game is available to play immediately; a live group game starts when the organiser starts it at the announced time.

5. Immediate start — no right of withdrawal

Before paying, you expressly ask us to make the game available immediately after payment and you acknowledge that you thereby lose your right of withdrawal. You confirm this by ticking a box at checkout. For live group games the game takes place at a specific date and time, for which there is no right of withdrawal either.

This does not affect your rights if the game does not work as it should (see section 6).

6. If something doesn't work

Please tell us straight away using “Report a problem” — in the game itself, or afterwards from the games overview. We ask for your e-mail address and phone number so we can deal with your report. The report automatically includes the technical details of your game, which helps us understand what happened.

We will reply within 30 days. Depending on the case, we will fix the problem, offer you another play, or refund the price in part or in full; refunds go back to the card you paid with. Your statutory rights in case of a faulty service are not affected.

7. Playing safely

You play in public spaces, at your own pace and at your own risk. Please:

  • follow traffic rules and local laws, and never look at your phone while crossing a road, cycling or driving;
  • don’t enter private property, closed areas or anywhere that is unsafe;
  • take care with heat and sun, carry water, and pause or stop whenever you need to;
  • remember that some tasks may take you to bars, shops or restaurants — buying anything there is your own choice and at your own cost, and alcohol should only be drunk responsibly.

We are not liable for loss, damage or injury that happens while you play, except where we caused it intentionally or through gross negligence, or where the law does not allow liability to be limited.

8. Fair play and the leaderboard

Don’t cheat — for example by faking your location, sharing answers or interfering with the app. We may remove results achieved unfairly. The leaderboard is public and shows your nickname (by default the name in your account), your profile picture if you have one, and your time.

9. Photos

Take only the photos a task asks for. Don’t photograph people without their permission and don’t upload anything illegal or offensive. Some photos are checked automatically by an AI system, which can make mistakes — if a correct photo is rejected, please report it.

10. Game content and changes

The games (texts, tasks, routes, images) are our work and are for your personal use only; please don’t copy or publish the answers or routes. We may change a game when needed — for example when a mural disappears or a street is closed. We may update these terms for future purchases; the version you accepted applies to your purchase.

11. Personal data (privacy notice for the Games)

The controller of your personal data in the Games is Jakub Krejci, Krajni 268/3, 415 01 Teplice, Czech Republic (info@krejcijakub.cz).

What we process and why:

  • Account: your e-mail, name, nickname and profile picture — to give you access and show the leaderboard (contract).
  • Game progress: answers, attempts, hints, skips, times and results — to run the game and the leaderboard (contract).
  • Location:used only at the moment you tap “Check my location”, to compare it with the checkpoint. We do not store your location.
  • Photos you take in a game — to check the task and to look into disputed cases (contract, legitimate interest). Some photos are checked by an AI service provided by Anthropic; under its terms Anthropic may not use them to train its models.
  • Payments: amount, status and payment references from Stripe — to process the purchase and keep accounting records (contract, legal obligation).
  • Problem reports: your e-mail, phone, description, screenshot and the technical details of your game — to deal with your report and any refund or payment dispute (contract, legitimate interest).
  • Automatic error log: technical errors the app runs into, with your device and browser type, screen size and the page — to find and fix bugs (legitimate interest).

How long: photos, report screenshots, problem reports and the error log are deleted automatically after 120 days. Account data and results are kept while your account exists. Payment records are kept as long as accounting and tax law requires.

Who helps us: Supabase (database and file storage, EU region), Vercel (hosting), Stripe (payments), Anthropic (AI photo check) and Resend (e-mails). Some of them are based in the USA; transfers are made on the basis of the safeguards required by the GDPR, such as the EU Standard Contractual Clauses or the EU–US Data Privacy Framework.

Cookies: the Games only use cookies that are needed to keep you signed in. During payment, Stripe may use its own cookies needed for secure payment and fraud prevention.

Your rights: you can ask for access to your data, its correction or deletion, restriction of processing and data portability, and you can object to processing based on legitimate interest — write to info@krejcijakub.cz. You can also complain to the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů, www.uoou.gov.cz) or to the data protection authority in the EU country where you live.

12. Governing law and disputes

These terms are governed by Czech law. If you are a consumer, this does not deprive you of the protection given to you by the mandatory rules of the country where you live. Disputes will be decided by the Czech courts; as a consumer you may also bring a claim in the courts of your country of residence.

For out-of-court resolution of consumer disputes, the competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz).

13. Languages

These terms are available in English and Spanish; both versions are equally valid.
